Terms of Service

1. Definitions
In these Terms, the following capitalised terms shall have the meanings set out below:
- “Account” means the registered user profile created by a User on the Platform.
- “Agency” means a User who has registered as an agency on the Platform and who manages one or more Creator accounts through the bonding mechanism described in these Terms.
- “Agency-Creator Bond” or “Bond” means the formal link between an Agency account and a Creator account established in accordance with Clause 9.
- “BSilk” or “we” or “us” or “our” means Blue Silk Limited (Company Number: 17051544), a company incorporated in England and Wales, whose registered office is at 167-169 Great Portland Street, London, United Kingdom, W1W 5PF.
- “Content” means any text, messages, images, data, or other material generated, transmitted, or processed through the Platform.
- “Credits” means the prepaid digital tokens purchased by Users and used to pay for Commission on the Platform. Credits are not currency, have no cash value, and are non-refundable except as expressly set out in these Terms.
- “Commission” means the fee deducted from a Creator’s Credit balance when the AI Chatter generates a successful Transaction on behalf of the Creator, calculated in accordance with the Progressive Commission Schedule in Clause 7.
- “Creator” means a User who operates a creator account on OnlyFans, Fanvue, or another Supported Platform and uses the BSilk AI Chatter service.
- “AI Chatter” means the artificial intelligence automated messaging and engagement service provided by BSilk through the Platform.
- “Fan” means an end subscriber or buyer on a Supported Platform who interacts with a Creator’s account.
- “Platform” means the BSilk website, application, API, and all related software and services operated by Blue Silk Limited.
- “Referral Link” means a unique URL assigned to each User that can be shared with prospective new Users to participate in the Referral Programme.
- “Referral Reward” means the ongoing commission of 15% of BSilk’s Commission earned from a referred User’s Transactions, credited to the referring User’s account as Credits.
- “Stripe” means Stripe, Inc., a third-party payment processor used by BSilk.
- “Supported Platform” means OnlyFans, Fanvue, or such other platforms as BSilk may designate from time to time.
- “Transaction” means a payment or purchase made by a Fan on a Supported Platform that is facilitated in whole or in part by the AI Chatter service.
- “User” means any individual or entity that registers for and/or uses the Platform, including Creators, Agencies, and any other account holders.
2. Acceptance of Terms and Eligibility
2.1 Acceptance
By accessing or using the Platform in any manner, including but not limited to creating an Account, purchasing BSilk$ Credits, or using the AI Chatter service, you agree to be legally bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
2.2 Eligibility
To use the Platform, you must:
- be at least 18 years of age;
- have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
- not be a person barred from using services of this nature under applicable law;
- hold an active, verified account on at least one Supported Platform (for Creator and Agency accounts);
- comply with the terms of service of all Supported Platforms on which you operate.
2.3 Age Verification and Adult Content
The Supported Platforms (OnlyFans and Fanvue) may involve adult content. You confirm that:
- you are at least 18 years of age;
- you have completed all required age verification procedures imposed by the relevant Supported Platform;
- you will not use BSilk in connection with any account on a Supported Platform that features content involving minors;
- you are solely responsible for ensuring that any Content generated by the AI Chatter complies with all applicable age verification and content laws in your jurisdiction and the jurisdictions of your Fans.
Content regulation on the Supported Platforms is governed by and enforced by those platforms. BSilk does not operate or enforce these systems and is not responsible for content policy decisions made by the Supported Platforms.
2.4 Changes to Terms
BSilk may amend these Terms at any time. We will provide notice of material changes by email to your registered address and/or by prominent notice on the Platform at least 14 days before changes take effect. Your continued use of the Platform after the effective date of any amended Terms constitutes your acceptance of those Terms.
3. Account Registration and Security
3.1 Registration
To access the Platform, you must register for an Account. You agree to provide accurate, current, and complete information during registration, maintain the security of your Account credentials, notify BSilk immediately at contact@bluesilk.ai if you suspect any unauthorised use of your Account, and accept full responsibility for all activity that occurs under your Account.
3.2 Account Types
- Creator Account: for individual creators operating on Supported Platforms who wish to use the AI Chatter service.
- Agency Account: for agencies managing one or more Creator accounts, as further described in Clause 9.
3.3 One Account per Platform Profile
Each Supported Platform account may be linked to only one BSilk Account at any time. Attempting to link a single Supported Platform account to multiple BSilk Accounts is a material breach of these Terms and may result in immediate Account suspension and forfeiture of Credits.
3.4 Account Suspension and Termination
BSilk may suspend or terminate your Account with or without notice if you breach any provision of these Terms, we reasonably suspect fraudulent or illegal activity, you provide false information, your Supported Platform account becomes inactive, or we are required to do so by law. Upon termination, unused BSilk$ Credits will be forfeited unless the termination is caused solely by BSilk’s breach.
4. The AI Chatter Service
4.1 Nature of Service
BSilk provides an AI-powered automated messaging and engagement service that operates on Supported Platforms on behalf of Creators. You acknowledge that the AI Chatter generates Content autonomously; BSilk does not guarantee any specific outcome, Transaction volume, or revenue; and you remain solely responsible for all Content generated by the AI Chatter in connection with your Account.
4.2 Creator Responsibilities
As a Creator using the AI Chatter service, you must maintain a valid, compliant account on the relevant Supported Platform; are responsible for the accuracy of information you provide to configure the AI Chatter; must not use the AI Chatter to send spam or violate Supported Platform rules; and accept full liability for any sanctions imposed by a Supported Platform arising from your use of the AI Chatter.
4.3 Service Availability
BSilk will use commercially reasonable endeavours to maintain the availability of the Platform. We do not guarantee uninterrupted service. BSilk shall not be liable for any loss resulting from service interruptions.
4.4 Supported Platforms Disclaimer
BSilk is not affiliated with, endorsed by, or in any way officially connected with OnlyFans, Fanvue, or any other Supported Platform. The Supported Platforms may change their terms of service or API access at any time, which may affect BSilk’s ability to provide its service. BSilk accepts no liability for such changes.
4.5 AI Content Guardrails and CSAM Prevention
5. Credits — Purchase and Use
5.1 Nature of Credits
BSilk$ Credits are prepaid digital tokens that fund Commission deductions on the Platform. Credits are not currency, have no monetary value outside the Platform, cannot be transferred between Users, cannot be redeemed for cash or cryptocurrency under any circumstances (except as provided in Clause 5.6), and do not earn interest.
5.2 Purchasing Credits
Credits may be purchased via credit or debit card through Stripe, or via cryptocurrency through our designated crypto payment provider. All purchases are in USD or such other currency as displayed at the time of purchase. BSilk reserves the right to change Credit prices at any time with notice.
5.3 Cryptocurrency Payments
Cryptocurrency transactions are irreversible once confirmed on the blockchain. You are solely responsible for sending the correct amount to the correct wallet address. Credits will be allocated once the required number of blockchain confirmations has been received. Exchange rate fluctuations are your risk.
5.4 Welcome and Referral Bonus Credits
New accounts created through direct signup receive $10 in welcome BSilk$ Credits. Accounts created via a valid Referral Link receive an additional $10 one-time bonus upon making their first Credit purchase (total starting balance: $20). These Credits are subject to the same terms as purchased Credits and cannot be claimed more than once per Supported Platform account.
5.5 Credit Expiry
Credits not used within 24 months of the date of purchase or allocation will expire and be forfeited. BSilk will provide at least 30 days’ notice before expiry by email to your registered address.
5.6 Refunds
BSilk$ Credits are non-refundable except where BSilk has materially failed to provide the AI Chatter service for a continuous period exceeding 72 hours through no fault of your own, or where required by applicable UK consumer protection law. To request a refund, contact contact@bluesilk.ai.
5.7 Statutory Right of Withdrawal (Consumer Contracts Regulations 2013)
If you are a UK consumer, you have a statutory right to cancel your purchase of BSilk$ Credits within 14 calendar days of the date of purchase. The refund will be for the full purchase price less a deduction for any Credits already consumed up to the date of cancellation. Welcome and referral bonus Credits are not subject to the Cooling-Off Period as they are provided at no charge. Refunds will be made to the original payment method within 14 calendar days of receiving your cancellation notice.
5.8 Credit Balance Priority for Agency-Bonded Creators
Where a Creator is bonded to an Agency, Commission will be deducted first from the Agency Credit balance (up to the allocation set by the Agency), then from the Creator’s own Credit balance. If both balances are insufficient, the Transaction will be queued pending top-up.
6. Payment Processing
6.1 Stripe
Card payments are processed by Stripe, Inc. By making a payment via Stripe, you agree to Stripe’s Terms of Service and Privacy Policy. BSilk does not store card details; all card data is handled by Stripe in accordance with PCI DSS standards.
6.2 Crypto Payment Provider
Cryptocurrency payments are processed by our designated third-party crypto payment provider, whose details will be displayed at the point of payment. BSilk is not responsible for the acts or omissions of the crypto payment provider.
6.3 Taxes
You are responsible for all taxes applicable to your purchase of Credits in your jurisdiction. Where BSilk is required by law to collect VAT or other taxes, these will be added at the applicable rate. BSilk will provide VAT receipts upon request.
6.4 Disputed Payments and Chargebacks
Contact contact@bluesilk.ai before initiating any chargeback or payment dispute. Initiating a chargeback without first contacting us may result in immediate Account suspension.
7. Commission Schedule
7.1 Progressive Commission
Commission is calculated on a progressive basis applied to each Creator’s cumulative monthly Transaction revenue:

Commission is deducted per Transaction at the marginal rate applicable at the time of the Transaction within the relevant monthly period. The monthly period resets on the first calendar day of each month.
7.2 Commission Rates Subject to Change
BSilk reserves the right to amend the Commission Schedule by providing not less than 30 days’ written notice. Amended rates apply to Transactions occurring on or after the effective date of the change.
7.3 Currency and Conversion
All Commission calculations are denominated in USD. Where a Transaction occurs in another currency, the USD equivalent will be calculated at the prevailing exchange rate at the time of the Transaction as determined by BSilk’s payment processors.
7.4 No Guarantee of Revenue
BSilk does not guarantee any specific level of Transactions, revenue, or Commission charges. The Commission Schedule reflects applicable rates only and does not represent any projection of earnings.
8. Referral Programme
8.1 Participation
Every User with an active Account may participate in the Referral Programme by sharing their unique Referral Link with prospective new Users. Participation is voluntary and subject to the rules in this Clause 8.
8.2 Eligibility — Invited User
A prospective User who signs up via a Referral Link will receive the one-time referral bonus Credits described in Clause 5.4, provided the invitee does not already hold a BSilk Account linked to the same Supported Platform account, the benefit is allocated once per Supported Platform account for the lifetime of that account, and the benefit is triggered on the invitee’s first Credit purchase.
8.3 Referral Reward for Inviter
The Inviter receives a Referral Reward equal to 15% of the Commission BSilk earns from the Referred User’s Transactions, credited as BSilk$ Credits for the lifetime of the Referred User’s Account. The Referral Reward is funded by BSilk from its own margin and does not reduce the Referred User’s Commission.
8.4 Pause of Referral Reward — Agency Bonding
If a Referred User enters into an Agency-Creator Bond with the Agency of which the Inviter is a representative or account holder, the Inviter’s Referral Reward will be paused with immediate effect. Upon dissolution of the Bond, the Referral Reward will resume automatically.
8.5 Termination of Referral Reward
The Referral Reward terminates permanently if the Referred User’s Account is terminated, the Inviter’s Account is terminated, or BSilk determines the referral was made in bad faith.
8.6 Anti-Abuse Rules
The following conduct is strictly prohibited and will result in immediate Account suspension and forfeiture of all Credits and Rewards: creating multiple Accounts to claim referral benefits more than once; using the Referral Programme to refer fictitious or self-controlled accounts; using automated tools to generate referrals; self-referral or circular referral arrangements.
8.7 Agency Referral Restrictions
Agency accounts may participate in the Referral Programme on the same basis as any other User. The Referral Reward is paused only when a specific Creator becomes bonded to the same Agency that the referring party represents, in accordance with Clause 8.4.
9. Agency Model
9.1 Agency Registration
Users wishing to operate as an Agency must register as such. An Agency is responsible for all use of the Platform by its Bonded Creators to the extent that Agency Credits are used and must ensure its Creators comply with these Terms.
9.2 Bonding Process
An Agency may establish a Bond by sending a Bond invitation to an existing Creator (who must actively accept), or by generating a single-use Creator invite link (valid for 7 days). A Bond is not valid until the Creator has actively accepted. No automatic bonding occurs.
9.3 Effects of Bonding
Upon establishment of a Bond: the Agency’s Credit balance becomes the primary source for Commission deductions up to the allocation set by the Agency; the Creator’s own Credit balance acts as a backup; the Referral Reward of any person who originally referred the Bonded Creator is paused; and Bonded Creators onboarded via the Agency pathway do not receive the referral bonus or welcome Credits.
9.4 Credit Allocation
The Agency must set a Credit allocation for each Bonded Creator representing the maximum Agency Credits usable per billing month. If no allocation is set, a default of $50 per month applies. The Agency will receive a notification when a Creator reaches 80% of their allocation. Allocation resets on the first calendar day of each month and does not roll over.
9.5 Unbonding
Either party may dissolve a Bond at any time. Upon unbonding: Commission reverts to the Creator’s own Credit balance; unused allocation for the current month is forfeited; a 48-hour cooling-off period applies before the same Agency and Creator may re-establish a Bond; and the Creator’s original Referral relationship resumes automatically.
9.6 Agency Anti-Exploitation
Agencies are specifically prohibited from: bonding Creator accounts they themselves own or control; repeatedly bonding and unbonding Creators to circumvent Credit allocation limits; aggregating Transaction volumes across Bonded Creators to achieve a lower Commission bracket (Commission is always calculated per individual Creator, per month); or operating an Agency account for fraudulent purposes.
10. Sales Team and Activation Bonuses
10.1 Sales Representatives
BSilk operates an internal and/or contracted sales team. Sales representatives use Referral Links to introduce prospective Creators and Agencies to the Platform and are subject to separate agreements governing their engagement.
10.2 Activation Bonus
Where a sales representative refers a User who creates an Account via the representative’s Referral Link and makes their first Credit purchase, a one-time activation bonus of $10 in BSilk$ Credits or cash equivalent may be payable, as agreed in the relevant representative’s agreement.
10.3 No Bonus Stacking via Agency
Sales representatives may not use the Agency onboarding pathway to claim activation bonuses per Bonded Creator. Only direct referrals via a Referral Link constitute an activation for bonus purposes.
11. Intellectual Property
11.1 BSilk IP
All intellectual property rights in the Platform, the AI Chatter technology, software, algorithms, designs, and trade marks are owned by or licensed to Blue Silk Limited. Nothing in these Terms grants you any rights in BSilk’s intellectual property other than a limited, non-exclusive, non-transferable, revocable licence to use the Platform for the purposes set out in these Terms.
11.2 User Content
You retain ownership of any Content you provide to configure the AI Chatter. By providing such Content, you grant BSilk a worldwide, non-exclusive, royalty-free licence to use, process, and store that Content solely for the purpose of providing the AI Chatter service to you.
11.3 AI-Generated Content
BSilk does not claim ownership of AI-generated Content created for your Account. You are solely responsible for the legality, accuracy, and appropriateness of AI-generated Content published through your Supported Platform account. BSilk does not warrant that AI-generated Content will be free of errors or will achieve any particular outcome.
12. Prohibited Conduct
You must not use the Platform to:
- violate any applicable law, regulation, or code of practice;
- generate, transmit, or facilitate any Content that is unlawful, harmful, threatening, abusive, harassing, or defamatory;
- generate, transmit, or facilitate any Content that depicts, describes, or promotes the sexual exploitation of minors or any other illegal sexual activity;
- impersonate any person in a manner that is deceptive or misleading to Fans;
- engage in any form of fraud, including misrepresenting the nature of the AI Chatter service to Fans;
- use automated tools to manipulate or inflate Transaction volumes, referrals, or metrics;
- attempt to reverse engineer or decompile the Platform or the AI Chatter;
- interfere with or disrupt the integrity or performance of the Platform;
- send spam, unsolicited communications, or engage in phishing through the Platform;
- upload or transmit malware or any harmful code;
- circumvent, disable, or interfere with security features of the Platform.
13. Data Protection and Privacy
13.1 Data Controller
Blue Silk Limited is the data controller of personal data collected in connection with the Platform, registered with the ICO under UK GDPR and the Data Protection Act 2018.
13.2 Privacy Policy
The collection, use, and processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
13.3 Fan Data
You are responsible for ensuring that the collection and processing of Fan data through your Supported Platform account complies with applicable data protection law. BSilk processes Fan data only as a data processor on your behalf for the purpose of providing the AI Chatter service.
13.4 Content Screening and AI Analysis
14. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law, BSilk’s total aggregate liability for all claims shall not exceed the greater of: (i) the total amount you have paid to BSilk in Credits in the six months preceding the claim; or (ii) $500. BSilk shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, loss of revenue, or loss of data.
Nothing in these Terms limits or excludes BSilk’s liability for death or personal injury caused by BSilk’s negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law including the Consumer Rights Act 2015.
14.4 Indemnity
You agree to indemnify, defend, and hold harmless Blue Silk Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or relating to: (i) your use of the Platform or the AI Chatter service; (ii) any Content generated by the AI Chatter in connection with your Account; (iii) your breach of these Terms; or (iv) your violation of any third-party rights or applicable law.
15. Third-Party Services and Links
The Platform may integrate with or link to third-party services, including Stripe, crypto payment providers, and the Supported Platforms. BSilk does not endorse and is not responsible for the content, accuracy, or practices of any third-party service. Your use of any third-party service is at your own risk and subject to that third party’s terms and privacy policy.
16. Term and Termination
These Terms commence when you create your Account or first use the Platform and continue until your Account is terminated. You may terminate your Account at any time by contacting contact@bluesilk.ai. BSilk may terminate or suspend your Account immediately and without prior notice for material breaches of these Terms.
Upon termination: your licence to use the Platform ceases immediately; all unused BSilk$ Credits are forfeited (subject to Clause 5.6); any active Agency-Creator Bonds are automatically dissolved; and provisions intended to survive termination (including Clauses 11, 12, 13, 14, 18, and 19) continue in full force and effect.
17. Disputes, Complaints, and Appeals
If you have a complaint, contact us first at contact@bluesilk.ai. We aim to acknowledge complaints within 2 business days and resolve them within 14 business days. If we cannot resolve a dispute through our internal process, you may refer the matter to a certified alternative dispute resolution (ADR) provider.
If your Account is suspended or terminated, you may appeal within 14 days of notification by contacting contact@bluesilk.ai. BSilk will notify you of the outcome within 21 business days. The outcome of an appeal is final.
18. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. If you are a consumer resident in Scotland or Northern Ireland, you may also have the right to bring proceedings in the courts of your country of residence.
19. General Provisions
- 19.1 Entire Agreement: These Terms, together with the Privacy Policy and any other documents incorporated by reference, constitute the entire agreement between you and BSilk.
- 19.2 Severability: If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary and the remaining provisions shall continue in full force.
- 19.3 Waiver: No failure or delay by BSilk in exercising any right shall constitute a waiver. A waiver is only effective if given in writing by an authorised representative.
- 19.4 Assignment: You may not assign your rights or obligations under these Terms without BSilk’s prior written consent. BSilk may assign its rights to any successor entity.
- 19.5 Force Majeure: BSilk shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control, including acts of God, pandemic, failure of telecommunications networks, changes in law, or acts or omissions of third-party service providers.
- 19.6 Notices: All notices to BSilk must be in writing and sent to contact@bluesilk.ai or to Blue Silk Limited, 167-169 Great Portland Street, London, United Kingdom, W1W 5PF.
- 19.7 No Partnership or Agency: Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and BSilk.
- 19.8 Rights of Third Parties: A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term, unless expressly stated otherwise.
- 19.9 Language: These Terms are written in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
Schedule 1 — Acceptable Use Policy
A. Content Standards
All Content configured by you and all Content generated by the AI Chatter must comply with the following standards:
- Content must not be illegal, unlawful, or infringe the rights of any third party.
- Content must not depict, describe, promote, or facilitate CSAM; non-consensual sexual acts; human trafficking; or any other criminal activity.
- Content must comply with the content policies of the relevant Supported Platform and all applicable laws.
- Content must not be false, misleading, or likely to deceive Fans in a material way.
B. AI Chatter Configuration
- You must provide accurate information about the persona and content type of your Supported Platform account when configuring the AI Chatter.
- You must not configure the AI Chatter to impersonate a real named person without their consent.
- You must not configure the AI Chatter to assert that it is a human when directly and sincerely asked by a Fan.
- You are responsible for reviewing AI-generated Content and must not knowingly allow unlawful Content to be published.
C. Platform Integrity
- You must not attempt to probe, scan, or test the vulnerability of the Platform or circumvent any security measures.
- You must not use the Platform in a way that places an unreasonable load on its infrastructure.
- You must promptly report any security vulnerabilities discovered to contact@bluesilk.ai.
